The Court of Appeal on Friday dismissed Senate President Bukola Saraki’s appeal against his trial by the Code of Conduct Tribunal (CCT).

The CCT is trying Saraki for refusing to fully declare his assets as governor of Kwara State.

Saraki had sought the Appeal court to stop the trial, but in a judgment delivered by Justice Moore Adumen on Friday morning, the Court of Appeal held that the trial by the CCT should continue.

According to Adumen, the CCT had once been misled into believing that a Federal High Court had ordered the stoppage of the trial.

The Court of Appeal also cited Section 174(1) and (2) of the constitution to prove that the absence of an Attorney General of the Federation does not stop Saraki from being tried.

 CCT: Saraki Goes To Supreme Court

Defeated at the Court of Appeal on Friday, Senate President Bukola Saraki is to take his battle against the Code of Conduct Bureau to the Supreme Court.

Saraki’s appeal to stop the Code of Conduct Tribunal (CCT)  was thrown out on Friday by the Appeal Court, but Saraki is believed to have concluded moves appeal the case at the Supreme Court.

Lead counsel to the Senate President, Mohammed Mogaji, stated this as part of his reaction to the ruling of the Appeal Court

Saraki is being tried by the CCT for his alleged refusal to fully declare his assets as governor of Kwara State.

Two of the three Appeal Court judges upheld Saraki’s trial while the third judge said the Senate President’s appeal had merit.

The two judges also held that against Saraki’s argument that the members of the CCT were not complete, the two judges held that the chairman of the CCT could sit with one other member as it was not compulsory that three members must be complete.

While ruling that the Code of Conduct Tribunal has powers to issue a bench warrants, the judges further held that the Solicitor-General can institute proceedings in the absence of the Attorney-General since the office of the AGF is statutory.
